LU Petitions US Supreme Court To Review ObamaCare Lawsuit

Liberty University says it has asked the U.S. Supreme Court to review a federal appeals court’s dismissal of its lawsuit challenging the Obama administration’s health care law.

The university and two individuals claim the law’s requirement that citizens buy health insurance or pay a penalty is unconstitutional.

A three-judge panel of the 4th U.S. Circuit Court of Appeals ruled last month that the penalty is a tax that cannot be challenged until it is paid and the taxpayer seeks a refund. Liberty attorney Mathew Staver announced the appeal Monday.

Virginia Attorney General Ken Cuccinelli also is appealing the 4th Circuit’s dismissal of his lawsuit challenging the law. The Obama administration has asked the Supreme Court to review an Atlanta-based appeals court’s ruling striking down the insurance mandate.
